Shopify Liability Shift Protection

Please note: Enrolment to the "Liability Shift Program" ended on December 11th 2015. Any orders for the Shopify Tap, Chip, and Swipe Card Reader (“EMV Card Reader”) made after this date are not eligible to join this program.

By pre-ordering the Shopify Tap, Chip, and Swipe Card Reader (“EMV Card Reader”) from Shopify Inc. (“Shopify”), you agree to be bound by the following terms and conditions (“Pre-Order Terms”), the Shopify POS Hardware Customer Agreement (“POS Hardware Agreement”) together with the Shopify and the Shopify Terms of Service (“Shopify Terms”). If there is a conflict between Pre-Order Terms and either of the POS Hardware Agreement or the Shopify Terms, the conflicting provisions of the Pre-Order Terms shall prevail. IF YOU DO NOT ACCEPT THE PRE-ORDER TERMS, THE POS HARDWARE AGREEMENT, OR THE SHOPIFY TERMS, DO NOT PRE-ORDER THE EMV CARD READER.

Payment

When you place a pre-order for the EMV Card Reader, your credit card will be authorized and charged at the time of pre-order. Applicable taxes and shipping costs will apply as of the date of purchase.

Delivery

Delivery of the EMV Card Reader will occur 6-8 weeks after the time of pre-order.  If delivery will not occur within 8 weeks after the time of pre-order, Shopify will notify you via email of such delay, and you may cancel your order to receive a full refund of the cost of the EMV Card Reader.

In the event that Shopify discovers a critical issue preventing us from fulfilling delivery of the EMV Card Reader, Shopify will notify you via email of such issue, and will issue you a full refund of the cost of the EMV Card Reader.  Shopify will extend the Shopify Liability Shift Protection Program for two weeks from the date of such notice.

Cancellation

You may cancel your pre-order of the EMV Card Reader at any time during the Pre-Order Period (as defined below).  If you cancel your pre-order of the EMV Card Reader, you will not be entitled to the benefit of the Liability Shift Protection Program after the date of your cancellation. 

Liability Shift Protection Program

Once you pre-order an EMV Card Reader and complete the Shopify Liability Shift Protection Program form we’ll provide to you with your pre-order confirmation (“Program Form”), you will be enrolled into Shopify’s Liability Shift Protection Program for the period beginning on the date you complete the Program Form, and ending on the date that you receive the EMV Card Reader (“Pre-Order Period”).  During the Pre-Order Period, Shopify will reimburse you, in the form of a Shopify Payments adjustment up to a maximum of $500 USD per account, for any chargeback losses (including chargeback fees) incurred from disputed orders where the order was placed by swiping a chip card through a Shopify swipe card reader and processed using Shopify Payments.  The Shopify Payments adjustment will occur within 45 days of the applicable issued chargeback.  For the avoidance of doubt, if you order multiple EMV Card Readers linked to the same Shopify account (“Account”), you will only be entitled to the maximum Shopify Payments adjustment of $500 USD per Account, regardless of the number of EMV Card Readers pre-ordered. If, after Shopify reimburses you for a chargeback under the Shopify Liability Shift Protection Program, you successfully dispute a chargeback and are refunded by a cardholder’s bank, Shopify reserves the right to reverse the Shopify Payments adjustment. Once you receive the EMV Card Reader, you will be automatically disenrolled from the Liability Shift Protection Program.  It is your responsibility to install and activate your EMV Card Reader immediately upon receipt in order to ensure you are not held liable for any chargebacks relating to chip cards.

In order to qualify for reimbursement under the Liability Shift Protection Program, the following requirements must be met:

  1. You must have pre-ordered an EMV Card Reader;
  2. You must have completed the Shopify Liability Shift Protection Program form provided to you with your pre-order confirmation;
  3. The Shopify store associated with the applicable chargeback must be registered to the Shopify Store URL entered at the time of pre-order;
  4. The transaction associated with the chargeback must have been made using a Shopify POS swipe card reader and processed using Shopify Payments;
  5. The card used for the transaction associated with the chargeback must contain a chip;
  6. The transaction date of the transaction associated with the chargeback must occur during the Pre-Order Period; and
  7. At the time of the transaction, you followed all card network rules in processing the transaction and had a good faith belief that the card used was a valid card

    If you cancel your pre-order of the EMV Card Reader at any time during the Pre-Order Period, you will not be eligible for reimbursement for any transaction occurring after the date we receive notice of your cancellation.
